Hi all,
We've been watching the NetApp/Oracle case at Spectra Logic with great interest, and our conclusions:
- The settlement is a "good thing" simply because things are moving along.
- The terms of the settlement are confidential so far. For us, this could mean anything. The deal could be exclusively between Oracle and NetApp, therefore other companies are left to fend for themselves. The deal could extend to OpenSolaris, which would be far better. We need to wait and see.
- CDDL protects us only from Oracle. It gives us license to *their* relevant patents. It does not indemnify us from prosecution by other companies who claim infringement.
Summary: wait and see. We should hear something more about it soon. In the meantime, Coraid and other companies are still just as exposed to NetApp as before.
Best regards,
Josh
