It should be a directory, in my 5.4-PRERELEASE:

> cd /usr/include/dev/
> ls -al | grep acpica
drwxr-xr-x   2 root  wheel   512 Mar  9 15:57 acpica

total 10
drwxr-xr-x   2 root  wheel   512 Mar  9 15:57 .

Try to cvsup once more the source!
