ports/162761: deve/pear refuses to install clean install 8.2

[portal:~] find /usr/ports/ -maxdepth 3 -type d -name work -print 
[portal:~] 

Ports tree perfectly clean.. 

It looks like however it checks to see if pear is installed is causing it to fail. Other ports don't seem to have this issue,  just not sure where else to check..
