As a quick update see below, still stumped on what's causing this
but does explain at least two of the other suspect behaviours.

Just been looking at the code and call be stupid but the
driver loads before root is mounted and hence before
/etc/rc.d/sysctl has run so how can adding values to this
possibly work?
Is this meant to say /boot/loader.conf?

The regular loss here is due to icmp limiting so is not a factor here.
