It would indeed be best if you could get an official statement from upstream on
whether they believe that packaging their software is covered by the license. 
Please ask them to point out which of the possible LICENSE_PERMS they believe
the license grants us.

Note that while we ship license files in packages, they are not "conspicuously
displayed" by default.  It is possible to supply a pkg-message to ensure they
are.  You should then also add

.if defined(NO_LICENSES_INSTALL)
IGNORE=         license requires that the license be shipped
.endif

or similar to the port to ensure that the license file is actually installed.
Please ask upstream if it suffices to just ship the license file, and if not,
if
mentioning the license in pkg-message suffices.  If that doesn't suffice
either,
we may have to supply LICENSE_PERMS=no-auto-accept to force the user to
acknowledge the license.
