I added these while preparing the patch to remove the fallback code -- not just the special case for the Capsicum issue in the small window referenced here, but all support for kernels without the syscall. That change is in review https://reviews.freebsd.org/D47636. I won't MFC the fallback removal but will MFC the comment update to stable/14 and stable/13.
